2. Definitions
●”Curee” refers to our company, known as Curee, and our mobile application, which provides a marketplace for scheduling appointments or ordering services from med spas and IV clinics.
●”Services” refers to the services provided by Curee, including but not limited to the use of our mobile application.
●”User” refers to any person or entity who uses our Services, including both service providers (med spas and IV clinics) and customers.
●”Service Providers” refers to med spas and IV clinics that offer their services through our mobile application.
●”Customers” refers to individuals who use our mobile application to schedule appointments or order services from Service Providers.
3. Our Role
Curee provides a platform for Service Providers and Customers to connect and transact business. Curee does not itself provide med spa or IV clinic services and does not employ individuals to perform these services. Instead, the Services enable Users to schedule appointments or order services from Service Providers. Curee is not responsible for the performance of Service Providers, the services they provide, or any actions or omissions of any Users.
4. User Accounts
To use our Services, you must create an account. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. You may not share your account or password with anyone, and you agree to notify Curee immediately of any unauthorized use of your password or any other breach of security.
5. User Conduct You agree not to use our Services to post or transmit any material which is harmful, offensive, defamatory, obscene, or which may infringe on the intellectual property rights of others, or which is threatening, false, misleading, or in violation of any law. You are solely responsible for the content you transmit through our Services.
6. Privacy and Data Security
Curee respects the privacy of its Users. Our collection and use of personal information in connection with the Services is described in our Privacy Policy.
7. Dispute Resolution
Any disputes between a Service Provider and a Customer must be resolved between the Service Provider and Customer directly. Curee is not a party to, and is not responsible for, resolving any such dispute.
8. Changes to the Terms Curee reserves the right to modify these Terms at any time. We will post the most current version of these Terms on our website. If you continue to use the Services after we change the Terms, your continued use of the Services constitutes acceptance of all changes to these Terms.
9. Termination Curee reserves the right to terminate or suspend your access to the Services at any time, without notice, for any reason whatsoever.
10. No Warranty
YOUR USE OF THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, CUREE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON- INFRINGEMENT. CUREE MAKES NO WARRANTY THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE BASIS; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY SERVICE PROVIDER’S SERVICES WILL MEET YOUR EXPECTATIONS. CUREE SHALL HAVE NO RESPONSIBILITY FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM YOUR USE OF THE SERVICES.
11. Limitation of Liability and Indemnification
EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD CUREE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEYS’ FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR YOUR USE OF THE SERVICES, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT OR THE USE OF THE SERVICES AND ANY VIOLATION BY YOU OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF CUREE HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF CUREE, CUREE’S LIABILITY WILL BE LIMITED TO THE AMOUNT PAID TO CUREE FOR THE SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
12. Governing Law; Venue Any legal action or proceeding relating to your access to or use of the Services is governed by the law of the State of Florida, and venue for any dispute arising under this agreement shall be solely and exclusively in the State and Federal Courts located in Tallahassee, Leon County, Florida.
14. Trademarks CUREE, CUREE.com, all images and text, and all page headers, custom graphics and button icons are service marks, trademarks and/or trade dress of CUREE. All other trademarks, product names and company names or logos cited herein are the property of their respective owners.
15. User Data Deletion
If you wish to delete your personal data and account from Curee, you can do so directly through the mobile application. Please follow these steps:
1. Open the Curee mobile application and log in to your account.
2. Go to Profile from the bottom menu.
3. Scroll down and tap on Delete Account.
4. You will be prompted to provide a reason for deleting your account.
5. Once you enter a reason and confirm, your account and all associated personal data will be permanently deleted from our system immediately.
